What Is Berry’s Story?

Elliston Berry is a typical fourteen-year-old school-going teen. However, in October 2023, she experienced a horrific incident when she discovered deepfake naked images of herself scattered across social media.

One photo of Berry standing on a cruise ship’s deck was edited to include a fake naked body. Other pictures of ladies in her friend’s group were created using actual beach images.

Elliston’s mother, Anna McAdams, was devastated when she found out about the images. She mentioned that,

As a mom, I knew immediately where the first picture was, but… if I didn’t know that, and I was just looking at the photo, I would probably think it was real

Berry revealed that one of her male classmates carried her deepfake images and the whole incident. According to a report by the Wall Street Journal, he took two pictures from her Instagram account and transformed them into a naked image using AI software.

Berry mentioned her experience as shameful and fearful at school. She said,

I felt like I had to tell everyone that it wasn’t real and that I was, I was just kind of fighting for what I thought was right

This incident generated a massive uproar from the public and law enforcement on what could be done to minimize it.

What Was The Response Of Texan Lawmakers?

The simple answer is ‘Take it Down Act.’ Texas Republican Senator Ted Cruz and Minnesota Democratic Senator Amy Klobuchar are among the lawmakers sponsoring the act.

According to the act, it would make it illegal to publish non-consensual intimate pictures, requiring social media providers to erase the information, and more.

Similarly, the bill plans to give required punishment to the offenders with two years jail time for a crime against an adult and three years for a crime against a minor.
